    QuRed Swimming Crabs caught in China were shipped whole and frozen to Indonesia for processing. Operations included weighing, sorting, thawing, steaming, cooling, handpicking, and packing in cans or freezing in bags. Cans were sealed, pasteurized, and refrigerated.
    CBP Determination: The processing in Indonesia resulted in a substantial transformation, creating a new and different article with a distinct name, character, or use. Country of origin: Indonesia per 19 CFR 134.1(b).ote Source

  • Case 2: Yacht Manufactured in Taiwan, Finished in China (Ruling No. N345287 | February 19, 2025)

    Quote SouThe Nordhavn 80 yacht’s hull, superstructure, decks, and tanks were constructed in Taiwan using fiberglass reinforced plastic (FRP) molds. Engines and stabilization systems were installed in Taiwan before shipment to China. In China, interior woodwork, cabinetry, stone countertops, stone floors, painting, plumbing, wiring, appliances, shafts, and propellers were installed.
    CBP Determination: Chinese operations constituted finishing operations to enhance the yacht and did not result in a substantial transformation. The essential character was imparted in Taiwan. Country of origin for Section 301 trade remedies and marking purposes: Taiwan.rce

  • Case 3: Crabmeat Processed in Vietnam (Ruling No. N349326 | May 28, 2025)

    Qote SourcIdentical crabs from China underwent the same processing operations (weighing, sorting, thawing, steaming, cooling, handpicking, canning/bagging, sealing, pasteurization, refrigeration) in Vietnam.


    CBP Determination: Vietnam’s processing effected a substantial transformation. Country of origin: Vietnam.

    Key Determination Principle:
    CBP applies the substantial transformation analysis (19 CFR §134.1(b)). A new country of origin is established only if processing in another country creates an article with a new name, character, or use (per Texas Instruments Inc. v. United States).

Peter Quinter is a world-renowned U.S. Customs and international trade law counselor and attorney who represents individuals and companies in a wide range of legal issues related to international trade and transportation, including litigation in various federal courts in Florida and in the U.S. Court of International Trade in New York. Peter is board-certified in international law by The Florida Bar. Peter is an expert in international law and has a passion for solving difficult problems faced by his clients.

Prior to joining Gunster, Peter was a partner in a large commercial law firm and head of the firm's U.S. Customs and International Trade Law Practice.
